1. Agreement to These Terms

These Terms of Service form a binding agreement between you and Achieve Personal Loans. By accessing this website, submitting the contact form, calling the studio or entering into a services agreement with us, you confirm that you have read and understood these terms and that you accept them.

If you are using this website or our services on behalf of an organization, you represent that you have authority to bind that organization, and references to you include that organization. If you do not have that authority, or if you do not accept these terms, please do not use the website or our services.

Where a signed services agreement, statement of work or master agreement exists between you and Achieve Personal Loans, that document governs the professional engagement and takes precedence over these terms if the two conflict. These terms continue to govern your general use of the website.

2. Who We Are

Achieve Personal Loans is a computer integrated systems design practice serving personal lending operations. Our office is located at 1875 S Grant St Ste 400, San Mateo - 94402-2676, United States (US). Our contact email address is help@achieveloans.lol and our contact phone number is +17087929143.

We provide professional, scientific and technical services in the field of computer systems design and integration. Our work includes lending systems design, decision workflow integration, borrower portal engineering, data migration pipelines, compliance reporting setups and ongoing systems support.

Achieve Personal Loans is not a bank, a credit union, a licensed lender, a broker, a loan servicer or a financial adviser. Nothing on this website should be read as an offer of credit, an invitation to apply for a loan or advice about a personal financial decision.

3. Use of the Website

You may view, read and print pages from this website for your own lawful business or informational purposes. You may link to our pages from a website you control, provided the link does not misrepresent our relationship or suggest an endorsement that does not exist.

You may not copy substantial portions of the website into another publication, present our content as your own or use our material to train a commercial model without written permission. Short quotations with attribution are welcome in ordinary editorial or scholarly use.

We reserve the right to change, suspend or withdraw any part of the website at any time. We are not obliged to keep any particular page available, and we may remove content that is out of date or no longer accurate.

4. No Lending or Financial Advice

This website describes professional systems design services. It does not offer loans, accept loan applications, quote interest rates for consumers or make credit decisions. Any figures, schedules or workflow examples shown on the site are illustrative and do not represent an offer to any person.

If you are a consumer looking for a personal loan, you should contact a licensed lender directly. We do not pass consumer inquiries to lenders, we do not receive referral fees from lenders and we do not maintain a list of consumer applicants.

Nothing we publish constitutes legal, tax, accounting or investment advice. Lending operations involve regulated activity, and clients should obtain advice from qualified professionals in their own jurisdiction before making decisions about compliance, disclosure or credit policy.

5. Scope of Professional Services

Our professional services are described on the services page of this website and are always documented in a written proposal or statement of work before work begins. The written document defines the deliverables, the schedule, the assumptions, the client responsibilities and the fee.

Any description on this website is general in nature. It is not a promise that a particular feature, integration or outcome will be available on a particular project. Scope changes are agreed in writing and may affect the schedule and the fee.

Unless a statement of work says otherwise, our services are performed on a time and materials basis by senior personnel. We do not subcontract core design or engineering work without your written consent.

6. Proposals and Client Agreements

A proposal from Achieve Personal Loans is valid for thirty days from its issue date unless it states a different period. A proposal is not a contract until it is countersigned or accepted in writing and, where required, until any initial payment has cleared.

Proposals are prepared on the basis of the information available at the time. If material facts change, such as a change of platform, a merger, a new regulatory requirement or a different volume of loan records, we may revise the proposal before or during the engagement.

Each engagement is independent. Signing one statement of work does not commit either party to any further phase, retainer or licence. Extensions are agreed separately and are priced at the rates in force at the time of agreement.

7. Client Responsibilities

A successful systems engagement depends on timely access to people, documents and systems. The client agrees to nominate a decision maker, to provide accurate information about its credit policy and reporting obligations, and to respond to design questions within a reasonable time.

The client is responsible for the lawfulness of its own lending practices, for the accuracy of the data it supplies, and for obtaining any consent or authority needed to share that data with us. We rely on the client to tell us about any restriction that applies to a particular data set.

Where the client provides access to production systems, the client remains responsible for its own environment, including access control, backups and change approval unless we have agreed in writing to take on a specific operational duty.

8. Fees, Invoicing and Payment

Fees are set out in the applicable proposal or statement of work. Unless otherwise agreed, invoices are issued monthly in arrears for time and materials work and on a milestone basis for fixed price work. Invoices are payable within thirty days of the invoice date.

Amounts that remain unpaid after the due date may attract a late charge at the rate stated in the agreement or, if none is stated, at the maximum rate permitted by applicable law. We may suspend work while an undisputed invoice remains overdue, after giving written notice.

Fees are exclusive of applicable taxes, which the client is responsible for paying. Pre approved travel and third party licence costs are recharged at cost with supporting documentation. If the client disputes an invoice, the client should notify us within fifteen days and pay any undisputed portion on time.

9. Deliverables and Acceptance

Deliverables are described in the statement of work, together with the criteria used to judge completion. Where an acceptance period is specified, the client reviews the deliverable within that period and either accepts it or provides a written list of specific deficiencies.

If the client does not respond within the acceptance period, the deliverable is treated as accepted so that the project can continue on schedule. Deficiencies that fall within the agreed scope are corrected at no additional charge. Requests outside the agreed scope are handled as a change request.

Documentation, test evidence and handover notes form part of the deliverable. A system is not treated as complete until its runbook and its reconciliation evidence have been provided, because those artefacts are what allow the client to operate the system independently.

10. Intellectual Property

All content on this website, including text, layout, styling, graphics and code, is owned by Achieve Personal Loans or is used under licence and is protected by copyright and other laws. Except for the limited permission described in the section on use of the website, no rights are granted to you in that content.

In client engagements, the statement of work sets out who owns the custom deliverables. Unless the agreement says otherwise, the client receives a perpetual licence to use the custom deliverables for its internal business, while we retain ownership of pre existing tools, methods and reusable components.

We may describe our work in general terms for the purpose of a portfolio, provided we do not disclose confidential information and provided the client has not asked us in writing to keep the engagement private.

11. Client Data and Confidentiality

Each party agrees to keep the confidential information of the other party in confidence, to use it only for the purpose of the engagement and to protect it with reasonable care. This obligation does not apply to information that is public, independently developed or lawfully received from a third party without a duty of confidence.

Where we process personal data on behalf of a client, we act on the documented instructions of that client and we apply the security measures described in the agreement and in our privacy policy. We do not use client personal data for our own marketing.

On termination, client data is returned or deleted as directed by the client, subject to legal retention requirements. Where deletion is not immediately possible because of backup rotation, the data remains protected and is removed on the normal backup cycle.

12. Third Party Components

Our systems often include third party components such as databases, cloud services, verification providers and open source libraries. Those components are governed by their own licences and terms, and we identify the significant ones in the project documentation.

We select third party components with care, but we do not control their roadmaps, pricing or availability. If a provider changes a term in a way that affects a delivered system, we will advise the client and propose a path forward, which may involve a change request.

You are responsible for complying with the licences of any third party component that you operate or distribute, and for maintaining any account or subscription that is registered in your name.

13. Website Availability

This website is provided on an as available basis. We aim to keep it online and accurate, but we do not guarantee uninterrupted access. Maintenance, hosting incidents, network problems and events outside our control may make the site temporarily unavailable.

We may change the content, structure or address of any page without notice. We are not liable for any loss caused by reliance on a page that has been superseded, and we encourage clients to rely on their signed engagement documents rather than on website descriptions.

14. Prohibited Conduct

You agree not to misuse this website or our systems. Prohibited conduct includes attempting to gain unauthorized access, probing for vulnerabilities without written permission, introducing malicious code, scraping at a volume that degrades service, and using the site to send unlawful, deceptive or harassing communications.

You also agree not to impersonate another person, to misrepresent an affiliation with Achieve Personal Loans, or to use our name or marks in a way that confuses clients about the source of a service.

We may investigate suspected misuse, restrict access and report unlawful activity to the appropriate authorities. We may also pursue any remedy available to us for loss caused by prohibited conduct.

15. Disclaimers

Except where a signed agreement provides otherwise, the website and its content are provided without warranties of any kind, whether express or implied. We do not warrant that the content is complete, current or suitable for a particular purpose, although we make reasonable efforts to keep it accurate.

Descriptions of services, examples of workflows and illustrative schedules are provided to explain our approach. They are not professional advice for your specific situation and should not be relied on without a written engagement that considers your facts.

Nothing in these terms excludes or limits any warranty or right that cannot lawfully be excluded or limited, including rights that may apply to consumers under local law.

16. Limitation of Liability

To the maximum extent permitted by law, Achieve Personal Loans is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill or business opportunity, arising from your use of the website or from any engagement, even if we have been advised of the possibility of such loss.

Our total aggregate liability arising out of or relating to an engagement is limited to the fees paid by the client for the twelve months preceding the event that gave rise to the claim, unless a different limit is stated in the signed agreement.

These limits do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited. The allocation of risk in this section is a fundamental part of the basis on which we price our services.

17. Indemnification

You agree to indemnify and hold harmless Achieve Personal Loans, its personnel and its contractors from claims, damages, losses and reasonable legal costs arising from your breach of these terms, your unlawful use of the website or your infringement of the rights of another party.

Where a client supplies data, content or third party materials for use in a project, the client confirms that it has the right to do so and agrees to indemnify us against claims that arise from that material. We will notify the client promptly of any claim and will cooperate in the defence at the client expense.

The indemnity does not apply to the extent that a claim results from our own negligence, wilful misconduct or breach of the signed agreement.

18. Termination

Either party may terminate an engagement for material breach by giving written notice and thirty days to cure, unless the breach is incapable of cure, in which case termination may be immediate. Either party may terminate for convenience on thirty days written notice, subject to payment for work performed and commitments already made.

On termination, the client pays for all work performed and all non cancellable third party commitments up to the termination date. We deliver work in progress and any completed deliverables for which payment has been made, and we return or delete client data as directed.

Sections dealing with confidentiality, intellectual property, payment, limitation of liability, indemnification and governing law survive the end of an engagement, because they continue to protect both parties after the work has finished.

19. Governing Law and Disputes

These terms are governed by the laws of the State of California and the federal laws of the United States, without regard to conflict of law rules. The courts located in San Mateo County, California have exclusive jurisdiction over any dispute that is not resolved by discussion, unless a signed agreement provides otherwise.

Before starting formal proceedings, the parties agree to attempt to resolve any dispute in good faith by written notice and a discussion between senior representatives within thirty days. This step is intended to preserve working relationships and to avoid unnecessary cost for both sides.

If a provision of these terms is found unenforceable, the rest of the terms remain in effect and the unenforceable provision is replaced by a valid provision that reflects the original intent as closely as possible.

20. Changes to These Terms

We may revise these terms from time to time to reflect changes in our services, our legal obligations or our business practices. The effective date at the top of the page records the most recent revision. Material changes are described in a short summary at the top of the revised page.

Continued use of the website after a revision takes effect indicates acceptance of the updated terms. A signed engagement is governed by the version of the terms referenced in that agreement unless both parties agree in writing to a later version.

If you do not agree with a revision, you may stop using the website and contact us to discuss the matter. Existing obligations under a signed agreement continue according to that agreement.
